Welcome to ClaimLynk (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, platform, services, and any related features (collectively, the “Services”). By using our Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

By accessing or using our Services, you represent and warrant that you are:

• Accessing the Services on behalf of a company, organization, or entity that has authorized you to agree to these Terms.

6. Healthcare Disclaimer

• ClaimLynk is a technology platform that provides AI-powered member and provider support solutions.

• ClaimLynk is not a healthcare provider, insurer, or financial advisor.

• Any information delivered through the Services (e.g., claim status, benefit summaries, provider searches) is for informational purposes only and should be verified with your TPA or plan administrator.

7. HIPAA & Data Protection

• To the extent ClaimLynk processes Protected Health Information (“PHI”), we do so under strict security protocols in compliance with HIPAA.

• TPAs and partners using ClaimLynk may be required to enter into a Business Associate Agreement (BAA) with us.

• You agree not to upload or share PHI unless authorized to do so.

8. Third-Party Links & Services

The Services may contain links to third-party websites or integrations. We are not responsible for the content, policies, or practices of those third parties. Access them at your own risk.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:

• Accuracy, completeness, or reliability of information.

• Uninterrupted or error-free operation.

• Fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law:

• ClaimLynk is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

• Our total liability for any claim shall not exceed the amount you paid (if any) to access the Services in the 12 months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless ClaimLynk, its officers, employees, and affiliates from and against any claims, damages, or expenses arising from:

• Your violation of these Terms;

• Your misuse of the Services; or

• Your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Services at any time if you:

• Violate these Terms;

• Engage in activities that disrupt or harm the Services; or

• Pose a legal or security risk.

13. Changes to the Services & Terms

• We may update or discontinue parts of the Services at any time without notice.

• We may update these Terms from time to time. Changes will be posted with a new “Last Updated” date. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes will be resolved in the courts of United States of America.
